L-1A Intra-Company Transferee Exchange or Manager
The L-1A visa allows US employers with their branches in foreign countries to transfer their employees of executive and managerial level to their United States’ offices. Additionally, this visa also allows foreign organizations that do not have an affiliated office in the States to send their executive or manager here to establish one. All employers, whether of the US or foreign countries, have to file a petition on behalf of the applicant.
Here are the general requirements for employers and employees under the L-1A visa category.
For Employers:
Employers must have a qualified relationship with the foreign organization i.e. should either be a parent company, branch, subsidiary or affiliate
For foreign organizations, it is essential to prove that they will be doing business in the United States while operating business from the main branch in the foreign country
For Employees:
The applicant employee must have worked for the qualified employer abroad for one continuous year within past 3 years
The applicant must be willingly looking forward to enter United States to occupy an executive or managerial post in the US branch of the qualified organization
Under the L-1A, qualifying employees entering US to hold the executive or managerial post for a new office will be allowed a maximum stay of one year initially. Qualified foreign employees for US employers can stay in the States for up to 3 years. All, L-1A employees can be granted an extension of 2 years at once, until they have reached the maximum stay limit of 7 years. For every extension, employers have to file a separate petition on employee’s behalf.
The L-1A visa allows the transferring employees to bring their dependent family members to the States, given that the family member is spouse/legal partner or children below 21 years of age. Accompanying family members are required to hold L-2 non-immigration visa.
