Additionally, employers can offer the job to foreign workers only when they cannot find a suitable match for the offered job in the United States. Also, they need to prove to the immigration authority that hiring foreign nationals will not affect the wages and working conditions for native workers. The employers are also required to submit a valid temporary labor certificate issued by the US department of Labor for the hired employee.
The H-2B visa is granted for the period allowed under the temporary labor certification. For qualifying employments an extension of 1 year is easily available. The maximum extension available on this visa is 3 years. Foreign nationals, who are already on 3 years extension on their H-2B visa and want to continue their employment, need to first leave the country and remain outside for at least 3 months before applying for another H-2B visa.
