US Employment Based Visa
The States’ Law has granted the U.S. based employers several ways to be able to invite people from other nations and join their workforce.
In order to offer an employment-based visa to a foreign national, obtaining a Labor Certification from the Department of Labors (DOL) and filing a petition with US Citizenship and Immigration Services (USCIS) are the first and foremost steps for the employer. He has to ensure that for the said vacancy, no willing and/or qualified workers from the States are available, who can fill in the position at an appropriate wage. This becomes important when there are chances that hiring foreign workers may discourage the potential resident workforce or adversely affect the current job scenario in that area.
There are two kinds of visas that fall under the US employment category – temporary and permanent. As far as the comparison goes, both have their own share of benefits and some drawbacks.
Temporary Employment Visas: Also known as non-immigrant visas, these are likely to be obtained by the employer with fewer hassles, and once the visa has been issued, the worker may travel right away to the United States to take up the job with the petitioning employer.Since the nature of visa is temporary and the tenure of job limited, the worker has to depart the United States upon the expiration of the visa. He/she can, however, apply for an extension, which is subject to USCIS’s approval.
Permanent Employment Visas: Also referred to as the “Green Card”, these visas legally allow a person to live, work and settle down permanently in the United States. With a permanent tenure in hand and fewer restrictions on their stay, most of these workers end up applying for a US citizenship after five years. However, the cases pertaining to the issuance of these visas take additional time since they belong to a numerically limited visa category.
Visa Requirements
Once a petitioning employer has obtained the required permissions for seeking a foreign worker, the visiting employee should keep a list of his documents ready to present during the visa interview. These include:
A valid Passport which does not expiretill60 days after the immigration visa has expired.
Form DS-260, Immigrant Visa and Alien Registration Application.
