US Fiance Immigration
U.S. citizens who wish to marry their foreign national fiancé within the United States need to apply for K-1 fiancé(e) visa. It is important that both the partners have met within 2 years prior to the filing of K-1 Visa. In case the foreign fiancé has children under the age of 21 who are unmarried, then K-2 visa needs to be applied for them as well to bring them to the United States.
Procedure for filling K-1 visa
The American fiancée files a petition on behalf of the foreign fiancée by submitting filled form I-129Fwith USCIS (United States Citizenship and Immigration Services).
After the petition is approved by USCIS, it is sent to the National Visa Center (NVC). The NVC process the case and gives it a case number, and then sends a petition to the Consulate where the applicant’s fiancée lives.
A letter is also sent by the NVC to the American citizen once his fiancé (e) case is sent to the foreign Consulate.
After receiving the letter, the foreign fiancée will have to apply for K-1 visa and appear for the interview.
Documents required at the time of interview
Printout of completed Online Non immigrant Visa Application Form DS-160.
A valid passport, which is valid for at least six months, beyond the intended time of stay in the U.S.
In case either of the partners have previous spouse(s), then the divorce or death certificate of their respective spouse(s).
Certificate from the police of the country where the non-U.S. national fiancé currently stays. Police verification is also needed from officials of all the countries where the non-national fiancé may have lived for six months or more since age 16.

Two (2) 2×2 photographs
Evidence of relationship with the U.S. citizen fiancé(e)
Payment of fees
The marriage needs to happen with 90 days of the non-U.S. fiancé’s entry into the country, as the visa is valid for 90 days only. If the marriage does not take place within 90 days, the fiancé will have to leave the country immediately. It is best to get married at the earliest as once a couple receives the marriage certificate, they can apply for adjustment of status.
After the marriage, the non- U.S. national fiancé can stay with his spouse and apply for permanent residency.
