The subclass 103 visa is for those foreign nationals, whose child is lawfully living in Australia. The Parent visa allows such immigrants to stay in Australia as permanent residents. In order to obtain this visa, the applying parent(s) must meet the following requirements:
They should be sponsored for this visa by their child living in Australia
They must meet the balance-of-family test*
* Equal or more number of their children should be living in Australia than in any other country.
In addition, the sponsoring child must be either:
An Australian citizen,
A permanent resident of Australia, or
An eligible New Zealand citizen
Also, the sponsoring child must have lived in Australia for at least two years immediately before the parent lodges the visa application.
The subclass 103 visa allows you to stay, work and study in Australia without restrictions. This visa remains valid for a period of 5 years, after which you need to apply for either Resident Return visa or another valid visa to continue your stay in the country. You can also apply for Australian citizenship, as well as sponsor your eligible relatives for permanent residency in Australia on your subclass 103 visa.
In case you are already present in Australia on temporary visa that allows you to apply for another visa, then also you can lodge an application for the subclass 103 visa. However, you must be outside Australia, both when you present your application as well as when the visa is decided.
This visa may take several years to get approved. Also, there are several norms that the applicant parent and sponsoring child need to keep in mind.
