Pathway to permanent residency in Australia through spouse or legal partner
The Partner visa (subclass 309 and 100) is for those foreign nationals who have a spouse or legal partner living lawfully in Australia. The application for this visa stream must be lodged outside Australia. The applicants must be sponsored by their legal spouse or legal partner living in Australia, who must be either:
An Australian citizen,
A permanent resident of Australia, or
An eligible New Zealand Citizen
The visa process for this stream has two stages, which are usually two years apart. In first stage, the applicant partner is granted the Provisional Partner visa, subclass 309, to stay in Australia on temporary basis. In the second stage, Migrant Partner visa, subclass 100, is given, which enables applicants to live in Australia as permanent residents. Applicants have to lodge only one visa application for both stages.
The Provisional Partner visa allows you to stay in Australia until the decision on your Migrant Partner visa is made. During this period you can enroll in short-term study courses, as well as work part-time in Australia. You can also enroll for Medicare, Australia’s public health-care scheme.
Once you are granted the Migrant Partner visa, you can work and study in Australia without restrictions. On subclass 100 visa, you can also apply for Australian citizenship, as well as sponsor your eligible relatives for permanent residency in Australia. Migrant Partner visa also lets you receive certain social security payments. The validity of this visa is 5 years, and after that time, you need to apply for another valid visa to continue your stay in Australia.
