Foreign nationals, who have a spouse or legal partner living lawfully in Australia, can apply for Partner visa (subclasses 820 and 801) to get permanent residency in Australia. The applicants must be sponsored by their lawful Australia Partner visa stream. In addition, applicant’s lawful partner must either be:
An Australian citizen,
A permanent resident of Australia, or
An eligible New Zealand citizen
The visa process for Australia Partner visa (subclasses 820 and 801) has two stages, which are usually two years apart. In first stage, the applicants are granted subclass 820 visa, which allows them to live in Australia on temporary basis. In second stage, the subclass 801 visa is decided, which allows applicants to live in Australia as permanent residents. There is only one visa application for both subclasses, which must be lodged in Australia. The applicants also need to be in Australia when their visa is approved.
You can stay in Australia on subclass-820 visa until the decision on subclass 801 visa is made. On subclass 820 visa you can enroll in short-term education courses, as well as work part-time in Australia. Subclass 820 visa also allows you to enroll in Australia’s public healthcare scheme, Medicare.
Once your subclass 801 visa is approved, you can work and study in Australia indefinitely for an initial period of 5 years. After this period, you need to apply for another valid visa to continue your stay in the country. Subclass 801 visa also lets you apply for Australian citizenship, as well as sponsor eligible relatives for permanent residence. On subclass 801 visa, you also get access to certain social security payments provided by government for native Australians.
Although, usually applicants have to wait for at least two years for their subclass 801 visa to get approved, but in certain cases the government can allow you to have your visa before this period is over.
